1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Creator", or "you") and Klipya ("Klipya", "we", "us", or "our"), governing your access to and use of the Klipya website at https://aitols.site, the Klipya Studio application, and all related tools, APIs, and services.

By accessing our website or using our video clipping tools, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Service Description & Creator Rights

Klipya provides automated and assisted video clipping, active speaker tracking, silence removal, subtitle styling, and 9:16 vertical video conversion software. You retain 100% full ownership of any source videos, clips, and exported footage you upload, generate, or render through Klipya.

Commercial Clearance: Clips exported by users on active subscription plans or eligible free tiers are 100% cleared for commercial distribution across YouTube, Instagram, TikTok, and other platforms, subject to the user holding proper rights to the underlying source video.

3. Acceptable Use & Content Guidelines

When utilizing Klipya, you agree not to upload, process, or render content that:

Infringes on the intellectual property, trademark, or copyright of any third party without legal license or fair use.
Contains unlawful, defamatory, harassing, sexually explicit, or abusive material.
Attempts to overload, reverse engineer, decompile, or compromise the server infrastructure or GPU rendering clusters.

4. Accounts, Subscriptions & Billing

Certain features of Klipya require an active membership plan. All payments and subscriptions are processed in accordance with our stated checkout terms.

Subscription plans grant rendering credits and feature tiers as described on the pricing section.
Credits and processing allowances are renewed per billing interval (7-day or 30-day terms as selected at checkout) and do not roll over.
Cancellation takes effect at the end of the current paid billing cycle.

5. Video Processing & Data Deletion Policy

Source footage uploaded to Klipya is stored temporarily on high-performance GPU processing scratch storage solely to perform transcoding, speaker detection, and clip rendering.

Data Retention: Uploaded source files and intermediate render segments are automatically deleted from server scratch storage after 2 hours. Rendered exported MP4 files are retained for 24 hours to enable download.

6. Limitation of Liability

Klipya is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Klipya shall not be liable for any indirect, incidental, or consequential damages resulting from service downtime, video rendering delays, or account access interruptions.
